What's wrong with this sentence?

From "Nevada Issues First Marijuana Delivery Licenses," on CNN Money: 
The state, which officially began selling legal marijuana on July 1, only issued its first license to actually transport the product from the farm to the store on Wednesday.
Emphasis ours. 

Although I don't think that was their intent, it makes it sound as though medical marijuana was not "legal."  Of course it was. Folks just had to have a medical license for it. 

I think the term they're looking for is "recreational marijuana" or "adult-use marijuana." Recreational marijuana buyers/users don't need a license! I.D. is required, however, to prove that the buyer has spent at least 21 years on earth.
